Fairly certain its neither– I believe it’s a hawk. Judging by the look of the streaking, in the genus buteo, and guessing location its most likely a broad winged hawk or red tailed hawk. juve red shouldered is also possible, but the tarsi length and outerwing coverts have me leaning BWHA
