Racism is ALSO a crime. Like, it’s literally one of few crimes defined in our constitution (Article 5 inc. XLI). It’s unbailable and earns you the exact same prison time.

Not only is racism ALSO a crime, but the way homophobia became a crime was by including it as an example of “racism” (for legal reasons only), meaning that the same law that forbids acts of racism also forbids acts of homophobia. Technically, the Supreme Federal Court did not rule that “homophobia is now punishable by prison”, it ruled that “since homophobia technically counts as racism in the legal system, it should receive the same punishment as racism, ie prison time”.
